I thought the case of Cristina Decena versus Philipp Salvador who was sued for estafa and was sentenced guilty by the Regional Trial Court is already final.
The action star appealed the case and the conclusion conclusion and recommendation ang Office of the Solicitor General (OSG) at ito ay tulad din ng sa RTC is that Phillip is guilty for the crime of estafa. It was denied however by the Salvador camp that this is already the decision of the Court of Appeals.

Walang katotohanan na nakapagbigay na ng desisyon ang Court of Appeals, gaya ng ilang naglabasan sa tabloids, na ang aktor na si Phillip Salvador ay nasentensiyahang "guilty" at makukulong ng anim hanggang 12 taon dahil sa estafe case na isinampa ng businesswoman at lover nito noon na si Cristina Decena.
Ang estafa case laban kay Phillip at sa kapatid nitong si Ramon Salvador ay unang isinampa ni Cristina sa Regional Trial Court (RTC) Branch 202 ng Las Piñas City.
Ayon sa bumabang desisyon ng RTC noong April 21, 2006, nakasaad na si Phillip "was found guilty beyond reasonable doubt of the crime of estafa and is hereby sentenced to suffer the indeterminate sentence of 4 (four) years two (2) months and (1) one day of prison correctional, maximum as minimum to twenty (20) years of reclusion temporal maximum as maximum and to indemnify the private complainant in the amount of ONE HUNDRED THOUSAND DOLLARS (US$ 100,000.00) or it's equivalent in Philippine currency."
Na-acquit naman ang kapatid ni Phillip na si Ramon dahil sa kakulangan ng ebidensiya.
Pero pagkatapos lumabas ang desisyong ito ng RTC, umapela si Phillip kung kaya't umakyat ang kaso ngayon sa Court of Appeals.
Ilan sa mga ipinahayag ni Phillip na dahilan ng pag-apela niya ay ang kawalan daw ni Cristina ng record para patunayan na meron nga siyang US$100,000 in cash. Wala rin daw mai-produce si Cristina na receipt signed by him for the amount. Nakasaad din sa apela ni Phillip na may ""ill motive" si Cristina—"a classic case of a woman scorned." At sa huli, "out of character" daw ni Phillip "to run away with Cristina's money."
Sa hindi nakakaalam, ang kasong ito ay may kaugnayan sa dimanao'y remittance business na itatayo sana ni Phillip sa Hong Kong, kung saan ibinigay raw ni Cristina kay Phillip ang US$100,000 bilang pagsimula ng naturang business. Pero later on, napag-alaman daw ni Cristina na hindi natuloy ang sinasabing business at hindi na rin daw naibalik ang pera sa kanya.
Ayon sa testimonyang ibinigay ni Cristina, sometime in May 2002 daw niya ibinigay ang pera kay Phillip sa bahay ng kanyang ina. Nakalagay raw ang pera sa isang envelope as seed capital para sa kanilang freight and remittance business.
Yun nga lang daw, upon the advice of Phillip, hindi gumawa ng anumang financial record or written evidence si Cristina. Because at that time, "she was at the midst of an annulment case."
Nakasaad din sa Brief for the Appellee na noong kinumpronta raw ni Cristina si Phillip ay inamin ng aktor na ginamit niya ang US$100,000 para bayaran ang kanyang mga utang. Nabigo rin daw si Phillip na i-settle o bayaran kay Cristina ang US$100,000.
Sa lumabas na Brief of Appelllee, nagbigay ng conclusion and recommendation ang Office of the Solicitor General (OSG) at ito ay tulad din ng sa RTC—that Phillip is guilty for the crime of estafa.
Lumabas ang naturang recommendation from the OSG sa Makati City, for the City of Manila noong January 13, 2009. But again, it is not yet the decision of the Court of Appeals.
Dito pa lang daw pagbabasehan ng Court of Appeals kung tulad ng RTC at recommendation ng OSG ay guilty rin ang magiging decision nila kay Phillip, o ang apela nito that he is not guilty.
Base sa aming nakuhang impormasyon, kung walang magiging aberya, posible raw na in two months time ay bumaba na ang desisyon ng Court of Appeals sa naturang kaso.
